Welcome to ZINGO! These Terms and Conditions ("Terms") govern your use of our mobile application (the "App") and any associated services provided by ZINGO (“we,” “us,” or “our”). By downloading, installing, or using our App, you agree to be bound by these Terms, South African law, and any other applicable regulations.
If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 18 years old or have the consent of a legal guardian to use the App. You agree to comply with these Terms and any applicable laws, including the Protection of Personal Information Act (POPIA) and the Electronic Communications and Transactions Act (ECTA).

2. Registration and Account

To access certain features of the App, you may be required to create an account. By creating an account, you agree to:
• Provide accurate and current information during the registration process.
• Maintain the confidentiality of your account details (username, password) and restrict access to your account.
• Notify us immediately of any unauthorized use of your account or any security breaches.
We reserve the right to suspend or terminate your account if we suspect any breach of these Terms or fraudulent activity.

3. Use of the App

You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:
• Engage in any activity that disrupts or interferes with the App or its functionality.
• Reverse-engineer, modify, or attempt to gain unauthorized access to the App’s systems or data.
• Upload or distribute any viruses, malware, or harmful content.
• Use the App in any manner that infringes upon the rights of others or violates any applicable laws.
Failure to comply with these requirements may result in the suspension or termination of your account.

4. Content and Intellectual Property

4.1 Our Content
All content provided in the App, including but not limited to text, graphics, logos, icons, and software (collectively, "Content"), is the property of ZINGO or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or modify any Content without our prior written consent.
4.2 User-Generated Content
You may submit content to the App (such as reviews, comments, or other materials) ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, and transferable license to use, modify, reproduce, and display such content within the App. You retain ownership of your User Content, and we do not claim any proprietary rights over it.
We reserve the right to remove any User Content that we consider inappropriate, offensive, or in violation of these Terms.

5. Fees and Payments

Certain features of the App may be subject to fees (e.g., in-app purchases or subscription services). You agree to pay all applicable fees and charges related to your use of the App. All payments are processed securely by third-party payment processors, and we do not store any payment information on our servers.
We reserve the right to change pricing or fees at any time. Any price changes will be communicated to you, and continued use of the App constitutes your acceptance of such changes.

6. Third-Party Services

The App may include links to or integrate with third-party services. These third-party services are not under our control, and we are not responsible for their content, privacy policies, or practices. Your use of such third-party services is at your own risk, and you should review their respective terms and conditions.

7. Data Privacy

We are committed to protecting your privacy and handling your personal information in compliance with POPIA. Please refer to our Privacy Policy for more information on how we collect, use, and protect your data.

8. Limitation of Liability

To the fullest extent permitted by South African law, we will not be liable for any damages or losses arising from your use of the App, including but not limited to:
• Direct, indirect, incidental, or consequential damages.
• Loss of profits, revenue, or data.
• Loss of use of the App due to technical issues or interruptions.
In no event shall our liability exceed the total amount of fees, if any, that you have paid to us during the 6 months prior to the event giving rise to the claim.

9. Indemnification

You agree to indemnify, defend, and hold us harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
• Your use of the App.
• Your violation of these Terms.
• Your infringement of any third-party rights, including intellectual property rights.

10. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, if we believe you have violated these Terms, engaged in fraudulent activity, or posed a security risk. Upon termination, your right to use the App will cease immediately, and you must uninstall and delete all copies of the App from your device.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of South Africa. Any dispute arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the South African courts.

12. Changes to the Terms

We may update or modify these Terms at any time. Any changes will be effective upon posting the updated Terms in the App. It is your responsibility to review these Terms periodically. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.

14. Severability

By downloading, installing, or using ZINGO, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
